AXIOLOGICAL CONTENT OF PREAMBLES TO CONSTITUTIONS OF CONSTITUENT ENTITIES OF THE FEDERATION (BY USING PREAMBLES TO REGIONAL CONSTITUTIONS OF GERMANYAS AN EXAMPLE )

Abstract

The relevance of the topic. An integral part of the system of Russian traditional values are the provisions of constitutional (statutory) legislation which have axiological content and significance and are determined by the national, economic and other characteristics of the region. There is a need for their in-depth scientific study in order to clarify their axiological content, develop ways, means of preserving, strengthening and legal protection of the system of Russian traditional values. An axiological analysis of the preambles to regional constitutions of foreign countries makes it possible to solve the problem effectively. Goal. Analysis of the preambles to the constitutions of German states from the position of their axiological content, identification of the peculiarities of fixing constitutional values in the German regional constitutional legislation. Methodology. Methods of comparative-legal and formal-legal analysis of constitutional norms establishing constitutional values in the preambles to the basic laws of the German states. Results and conclusions. The analysis of sixteen preambles of the constitutions of the German states revealed the axiological nature of their content. Among the key properties of regional constitutional values the following were identified: axiological multidimensionality, balance of interests of constitutional-legal relations, their conditioning by historical and cultural context. Scope of application. The results of the study can be used in the analysis of state (federal and regional) policy on the preservation and strengthening of Russian constitutional values, their legal protection, as well as in designing special courses for legal, economic and political science specialities and areas.
